General Terms & Conditions
Last updated: September 2026
These Terms & Conditions (“Agreement”) apply to all photography services provided by MatthewKPhotography (“the Photographer”) to any client (“the Client”). By booking, paying a deposit, or using the Photographer’s services, the Client agrees to these Terms & Conditions.
1. Changes to This Agreement
Any changes to these Terms & Conditions must be agreed in writing by both Parties.
2. Services Provided
The Photographer will provide professional photography services as agreed with the Client. Specific details — including the package, duration, deliverables, and total fee — will be outlined in a separate Scope of Services or booking confirmation.
3. Deposit & Payment Terms
3.1 A non‑refundable deposit of 50% of the total fee is required to secure any booking. 3.2 The deposit must be paid within two (2) days of the invoice date. If unpaid, the Photographer may accept other bookings for the same date. 3.3 The remaining balance is due no later than one (1) week before the scheduled service date.
4. Cancellation Policy
Client Cancellation
4.1 If the Client cancels up to 48 hours before the scheduled service, fees paid (excluding the deposit and any costs already incurred) will be refunded. 4.2 Cancellations made less than 48 hours before the service result in forfeiture of the entire fee.
Photographer Cancellation
4.3 The Photographer may cancel at any time prior to the service. If this occurs, the deposit will be refunded.
5. Client Responsibilities
The Client agrees to:
Provide meals/refreshments if the Photographer is required on‑site for five (5) hours or longer.
Communicate any venue restrictions or guest privacy requests in advance.
Provide reasonable notice of key moments or important activities the Client wishes to have photographed.
6. Model Release
6.1 The Client grants the Photographer the right to use images for editorial, advertising, promotional, portfolio, website, and social media purposes. 6.2 The Client confirms they have obtained consent from all individuals photographed. 6.3 For minors, the Client confirms they have written permission from the parent/guardian and will provide proof upon request.
7. Additional Fees
Additional charges may apply for:
Second shooter (starting at £300)
Image retention, archiving, USB delivery
Travel and accommodation
Prints, albums, or bespoke products
8. Creative Control
The Photographer retains full creative control over composition, lighting, editing, and artistic style. Subjective preferences or aesthetic disagreements are not grounds for refunds or reshoots.
9. Copyright & Usage
9.1 All photographs remain the copyright of the Photographer. 9.2 Commercial use by the Client is prohibited without written permission. 9.3 Clients may share images publicly or on social media with clear credit (e.g., “Photo by MatthewKPhotography”). 9.4 Images may not be altered, cropped, or edited without written permission.
10. Image Retention & Archiving
10.1 Online galleries remain accessible for a minimum of three (3) months. 10.2 USB delivery is available for £25 unless included in the package. 10.3 After gallery closure, digital access may be arranged at £25 per month. The Photographer does not guarantee indefinite archiving.
11. Additional Terms
The Photographer will make reasonable efforts to photograph as many subjects as possible.
The Photographer must be given priority over guests using phones or cameras.
Venue rules may limit what can be captured.
Overtime is charged at £150 per hour.
Delays must be communicated; otherwise, the Photographer may leave at the agreed end time.
Up to 15 minutes of extra coverage may be provided at the Photographer’s discretion.
12. Goodwill Refunds
In cases of documented medical emergencies, the Photographer may offer a partial goodwill refund at their discretion.
13. Dispute Resolution & Legal Fees
Parties will attempt to resolve disputes through good‑faith discussion and may consider mediation before legal action. The prevailing party in legal proceedings may recover reasonable legal fees.
14. Force Majeure
The Photographer is not liable for delays or cancellations caused by events beyond their control (e.g., natural disasters, illness, government restrictions). If cancellation occurs due to such events, a refund will be issued minus any non‑refundable costs already incurred.
15. Severability
If any part of this Agreement is found invalid, the remaining provisions remain enforceable.
16. Entire Agreement
This Agreement supersedes all prior discussions. Any modifications must be made in writing and signed by both Parties.
17. Governing Law
This Agreement is governed by the laws of England and Wales, and disputes will be handled exclusively by the English courts.
